The landscape for hemp and hemp-derived cannabinoid products is undergoing a major shake-up — and as part of the hemp community, Chillum is watching closely. On November 17 2025, Nancy Mace (R-S.C.) introduced draft legislation — the “American Hemp Protection Act of 2025” — to repeal the new federal restrictions on hemp products embedded in the funding bill that reopened the U.S. government.

Here’s what is happening, what it means for our industry (and for Chillum), and how we can all adapt and stay ahead.

What’s going on?

As part of the continuing resolution to fund the federal government, Congress included Section 781 which redefines the legal definition of hemp. Under the new language:
- Hemp must test under 0.3% total THC (including THCA) by dry weight.
- Products derived from hemp that include synthesized or manufactured cannabinoids (outside the plant) may be excluded from the “hemp” definition.
- Any hemp-derived cannabinoid product containing more than 0.4 milligrams of total THC per container (or cannabinoids deemed to produce “similar effects”) would fall outside the legal hemp definition.
- The provisions take effect Nov. 13 2026 — giving roughly one year of runway.
Rep. Mace is circulating draft legislation to repeal the Section 781 provision. Her argument: this restriction was slipped into a must-pass funding bill, overriding what she sees as a legitimate, regulated hemp industry with tens of billions in economic activity.
The hemp industry estimates: ~320,000 jobs, ~$28.4 billion in regulated market activity, ~$1.5 billion in state tax revenue.

Why it matters for Chillum and our community

Product availability & formulation: Many products that leverage hemp-derived cannabinoids (including the more minor cannabinoids) may face legal risk under the new definition. That means reformulation, withdrawal, or transformation of product lines may become necessary.
Consumer awareness & education: Our customers trust Chillum for transparency, quality and access. If federal definitions shift, we’ll need to communicate clearly about what products remain legal, which are under review, and how we’re adjusting.
Regulatory timing: The one-year delay gives a window, but also creates uncertainty. It’s a strategic moment to plan — for our operations, supply chain, compliance, and customer communications.
Opportunity for leadership: Chillum’s history (as one of Florida’s pioneer CBD and mushroom-focused dispensaries) positions us to engage proactively — with suppliers, regulators, and our community — to shape the transition.
Risk of black-market displacement: One of the consistent arguments raised by industry advocates is that sweeping bans or overly restrictive definitions may drive consumers to unregulated sources. That risks undermining safety, quality and the values we promote at Chillum.
