Florida Fails to Ban Hemp—For Now. But the Fight Isn’t Over.

Florida lawmakers just ran out of time.

Despite months of lobbying, media fear-mongering, and corporate cannabis influence, the Florida Legislature failed to pass a bill that would have devastated the state’s hemp industry. Senate Bill 1698, which sought to ban popular hemp-derived products like Delta-8 and Delta-10 THC, died on the final day of the 2025 legislative session.

This is a win—but not the end of the war.

What Happened?

SB 1698 would have imposed harsh restrictions on hemp, redefining what qualifies as legal and banning many of the products customers have come to rely on—especially those using hemp for therapeutic relief or as a legal alternative to cannabis. The bill cleared the Senate in a 29-9 vote, but faced strong pushback in the House. With only hours left in session, the two chambers failed to agree on the details, and the bill quietly died.

Why Did It Fail?

Advocacy played a big role. Florida’s hemp farmers, small business owners, and thousands of concerned citizens raised their voices, sending a clear message: the hemp industry is vital, and overregulation serves only the biggest corporate interests. Lawmakers also struggled to define what an “intoxicating” hemp product really is—because it’s not so simple.

House Speaker Paul Renner hinted that lawmakers are likely to try again next year, saying the state still needs to “close the loophole” on these products.
