The agency is poised to officially define what constitutes a “cartoon” under state hemp laws, aiming to tighten the rules around packaging and design that might attract children.

Florida law already prohibits hemp products that are “attractive to children”—namely those shaped like humans, animals, cartoons, or resembling recognizable candy brands, or containing vivid colors. Enforcement efforts, including a persistent sweep dubbed Operation Safe Summer, have resulted in more than 800,000 products being pulled from shelves for non‑compliance.

FDACS’s proposed rule seeks to clarify ambiguity by defining a “cartoon” as “any drawing or other depiction of an object, person, animal, creature, or any similar caricature”, if it includes:
- Comically exaggerated features,
- Human traits attributed to animals, plants, or objects (anthropomorphism), or
- Unnatural or superhuman abilities, such as invulnerability, x-ray vision, supersonic speed, or transformations.
This language is borrowed from existing tobacco litigation, reflecting an attempt to draw a parallel between product marketing strategies designed to appeal to young consumers.
